This Privacy Policy is here to better serve those who are concerned with how their information is used online. The following describes what type of information we collect, what it’s used for, and the measures we take to protect it.

  1. Definitions

“Company”, “We”, “Our”, or “Us” means Rozzie Fitness, LLC.

“Content” means any and all written, visual, video, or audio information contained on the Site, including, but not limited to, any and all emails received from the Company or its employees or independent contractors and any and all written or downloadable material purchased, viewed, or otherwise offered by the Company, such as blog posts, graphics, newsletters, designs, documents, information, templates and materials.

“Personal Information” means information that can be used on its own or in conjunction with other information to identify, contact, or locate a person, or to identify an individual in context. For example, personal information includes, among other things, your name, address, email address, telephone number, credit card information, and site behavior.

“Site” means www.rozziefitness.com; Rozzie Fitness’s TeamUp, Eventbrite, Instagram, Facebook, LinkedIn, and Nextdoor pages; and anywhere else we interact with you online.

“You” or “Your” means the user, customer, or viewer of the Site.

2. Company Statement:

The Site and its Content are owned by the Company.

The Company is committed to protecting your Personal Information. We will only collect or use your Personal Information in accordance with this Privacy Policy.

3. What kind of Personal Information do we collect?

Personal Information You Provide: 

When using the Site, and in filling out forms, purchasing products, providing comments, or contacting us, you may be asked to enter your name, email address, website address, mailing address, mobile phone number, or payment information. We use this information to deliver the product purchased or information requested; to improve the Site’s performance; and to provide you with educational content, newsletters, promotions, and special offers. 

Personal Information Automatically Collected:

The Company may use data collection technology, such as Squarespace Analytics and Google Analytics (hereinafter referred to as the “Data Collection Companies”), to collect information related to your use of the Site. Generally speaking, this includes information about your geographic location and Site behavior. The Data Collection Companies also provide us with information about what type of device or software you use, your IP address (with location information), and whether you view the Site on mobile, tablet, or desktop.

We collect this information for statistical purposes and to improve the viewer experience.

Personal Information from Other Sources:

We may receive Personal Information about you from other sources as well. Examples of these sources are entities that can help us correct our records, improve the quality or personalization of our service to you, and help prevent or detect fraud.

4. What if the Personal Information we have about you is incorrect or you want to update it?

We will make the appropriate corrections when notified, as long as the corrections requested to be made are not incorrect or fraudulent.

5. When do we collect Personal Information?

We collect Personal Information from you when you use the Site in any way. If you’re just viewing the Site, we won’t ask you to provide Personal Information but may still automatically collect Personal Information from you pursuant to Section 3. 

Email List

If you're outside of the European Union (“EU”): If you sign up to receive any freebies, downloads, webinars, recordings, courses, or services from the Company, or purchase any products or services from us, you may automatically be added to our email list and may receive free email messages from us. You can unsubscribe at any time by clicking "UNSUBSCRIBE" at the bottom of each email. If you have any questions, or difficulty unsubscribing from those emails, email Lianna DeBor at info@rozzieiftness.com to be unsubscribed from future messages.

If you're inside of the EU: If you sign up to receive any freebies, downloads, webinars, recordings, courses, or services from the Company, or purchase any products or services from us, you will be added to our email list and will receive free email messages from us only if you affirmatively consent to receiving such messages. We will send you periodic SMS messages only if you affirmatively consent to receiving such messages. Message/data rates apply. Text STOP to opt out.

6. How do we use your Personal Information?

We may use the Personal Information we collect from you in the following ways:

  • To personalize your experience and deliver the type of content and product offerings in which you are most interested.

  • To improve our Site.

  • To better respond to your customer service requests.

  • To administer a contest, promotion, survey, or other Site feature.

  • To quickly process your transactions on the Site.

  • To send periodic emails and SMS messages regarding the Site and Content.

  • To tailor social media advertisements to you.

7. Do we share your Personal Information with anyone?

  • to assist social media platforms, including, but not limited to, Instagram, Facebook, LinkedIn, and Nextdoor, that can be used through the Site (e.g., sharing a link to Facebook). If you use social media functionalities on the Site, your information will be shared with those platforms to complete those functions and activities.

  • to facilitate the acquisition of all or substantially all of our assets in the unlikely event that an unrelated third party conducts such an acquisition. 

  • to assist with third-party advertising, such as advertising on social media platforms, by tracking and categorizing your interests and behavior on our Site. We may share information with third-party companies, and these companies may collect information, including your actions taken on the Site, through tracking methods such as cookies. These third parties may also get information about you from your behavior and actions directly with the third parties; your behavior and actions on other websites or mobile apps; companies that the third-party companies work with; or your interactions with advertisements the third-party companies show you. The information that these companies collect or that we share may be used to customize or personalize advertisements that are displayed to you.

Non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses. 

If you make your Personal Information available to third parties through our Site or Content, we are not responsible for any unauthorized use by that third party.

We allow third-party behavioral tracking. For more information see section 3.

8. How do we protect your Personal Information?

Because no method of transmission over the Internet, or method of electronic storage, is one-hundred percent secure, we cannot guarantee your Personal Information’s absolute security. However, we aim to make your visit to the Site as safe as possible. The Site uses commercially acceptable methods of security protection to protect your information.

We use a Secure Sockets Layer (SSL) certificate. Your Personal Information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems and are required to keep the Personal Information confidential. By viewing or using the Site, you acknowledge that the Company and its staff and independent contractors may access your Personal Information.

All transactions are processed through a gateway provider and are not stored or processed on our servers. The gateway provider adheres to Payment Card Industry Data Security Standards (PCI Standards). These standards require safeguards for handling and securing customer information. 

We may change our hosting, storage and security procedures at any time without notice to you.

9. Do we use 'cookies' or social media pixels?

Cookies. We, and third parties as described in Section 7, use cookies and collect information from the computer, mobile phone, or other device you use to access the Site, read our emails, or view our advertisements. This information is automatically collected. Cookies are small data files that a site or its service provider transfers to your computer's hard drive through your Web browser (if you allow) that enables the site or service provider's systems to recognize your browser and capture and remember certain information. For instance, we use cookies to help us remember and process the items in your shopping cart. They are also used to help us understand your preferences based on previous or current Site activity, which enables us to provide you with improved services. We may also use cookies to help us compile aggregate data about Site traffic and Site interaction so that we can offer better site experiences and tools in the future (we may use trusted third-party services that track this information on our behalf).

Although you may disable the use of cookies through your browser’s settings, if you do so you may lose some of the features and functionality of the Site, as cookies are necessary to help track and enhance your experience on the Site.

Pixels. We may use social media pixels in accordance with the terms of the social media platform to track visitors to the Site so we can tailor advertisements toward those visitors on various social media platforms.

10. Third-Party Links:

Occasionally, at our discretion, we may include or offer third-party products, services, or links to articles, blogs, or websites on our Site. These third-party sites may or may not have separate and independent privacy policies. We have no responsibility or liability for the content and activities of these linked sites or their privacy policies (or lack thereof). Nonetheless, we seek to protect our Site’s integrity and welcome feedback about any issues you experience with linked-to sites. You can email us feedback at info@rozziefitness.com.

11. Password Privacy:

While using the Site and Content, you may create a username or password for login. It is your responsibility to keep the username and password safe. You are also responsible for any actions which occur through the use of your username and password, whether completed by you directly or through the use of your account. You shall notify us immediately by email to info@rozziefitness.com of any unauthorized use of your login information or any other security breach. Please log out at the end of each session to prevent any unauthorized use of your account or login information.  

You may not share your username, password or other login information with anyone. We are not responsible or liable for any loss or damages as a result of your failure to protect your login information.

12. California Residents: 

California Online Privacy Protection Act (“CalOPPA”):

Pursuant to the CalOPPA, we state the following:

  • On www.rozziefitness.com, there is an easily visible link to this Privacy Policy that includes the word “Privacy.”  

  • We reserve the right to change, amend, or otherwise alter this Privacy Policy at any time without notice to you. When changes are made to this Privacy Policy, we will update the “Updated on” date at the bottom of this page. Please check periodically to keep informed of any changes. Your continued use of the Site following the posting of any changes to this Privacy Policy constitutes acceptance of those changes.

  • We do not respond to DNT:1 signals from browsers.

California Consumer Privacy Act (“CCPA”):

Pursuant to the CCPA, we state the following:

  • We will grant you reasonable access to the data that we have collected, used,  disclosed, and sold in the preceding 12 months as required by law. You may also be entitled to request copies of Personal Information that you have provided to us or request us to transmit this information to another service provider (where technically feasible).

  • We rely on you to update and correct the Personal Information you have provided to us. Please update your Personal Information either through the Site or by emailing us at info@rozziefitness.com. We may keep historical information in our backup files as permitted by law. 

  • Unless otherwise required by law, we'll keep your Personal Information until either (1) you ask us to delete your Personal Information, or (2) the Company decides it no longer needs the data and the cost of retaining it outweighs the value of keeping it. You may request that we delete your Personal Information by emailing us at info@rozziefitness.com. Although we generally will grant a request to delete information, we may deny your deletion request for any reason permitted by law. 

  • We do not sell your Personal Information.

When you exercise your rights pursuant to the CCPA, the following guidelines apply:  

  • You will not have to pay a fee to access your Personal Information (or to exercise any of your other rights pursuant to the CCPA). However, we may charge a reasonable fee or decline to comply with your request if it is clearly unfounded, repetitive, or excessive.

  • We may need to request specific information from you to help us confirm your identity. We may also contact you to ask for further information regarding your request.

  • We will endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. We will deliver our written response to you electronically. Any disclosures we provide will cover only the 12-month period preceding the verifiable consumer request’s receipt. If we cannot comply with a request, we will explain why in our written response. For data portability requests, we will select a format for transferring your Personal Information that should allow you to transmit the information from one entity to another easily.

  • You will not be subject to discrimination as a result of exercising your CCPA rights. In some cases, we will be unable to comply with your request due to legal obligations or otherwise. Our response will not be the result of discrimination and you will be provided with our reasons for declining your request.

  • You may designate an authorized agent to make a CCPA request on your behalf. An authorized agent may make a CCPA request on your behalf only if you or the authorized agent mails us a valid power of attorney, the requester’s valid government issued identification, and the authorized agent’s valid government issued identification.

13. Children’s Online Privacy Protection Act (“COPPA”):

We do not specifically market to children under the age of 13. Please STOP and do not view or use the Site or Content if you are under 13 years old. If you’re younger than 13, you are not permitted to enter any Personal Information on this Site.

If you are a parent and you believe your child under the age of 13 has provided us with Personal Information, please contact us immediately to have it removed by emailing us at info@rozziefitness.com.

14. CAN-SPAM Act of 2003:

The CAN-SPAM Act is a U.S. law that establishes rules for commercial email messages, gives you the right to stop certain commercial emails from being sent to you, and outlines certain penalties for commercial entities or persons who violate the law.

We collect your email address and name so we can:

  • Send information, respond to inquiries, and process other requests or questions.

  • Process orders and send information and updates pertaining to orders.

  • Send you additional information related to Content.

  • Market to our mailing list or continue to send emails to you after the original transaction has occurred.

  • Email you a newsletter with free information and advertising regarding Content.

In accordance with the CAN-SPAM Act, we agree to the following:

  • We will not use false or misleading subjects or email addresses.

  • We will identify our email messages as advertisements in some reasonable way when such a designation is required.

  • We will include our business mailing address or physical address in our emails.

  • We will monitor third-party email marketing services for compliance. We use ConvertKit and Gmail to send our emails to you.

  • We will honor opt-out and unsubscribe requests quickly.

  • We will allow users to unsubscribe by using the appropriate link at the bottom of each email.

If at any time you would like to unsubscribe from receiving future emails, you can email Lianna at info@rozziefitness.com or follow the instructions at the bottom of any email you receive from us and we will promptly remove you from future correspondence. However, unsubscribing from one list or set of emails may not unsubscribe you from receiving ALL future emails from us. If you experience any problems unsubscribing, please email Lianna at info@rozziefitness.com and we will promptly handle your removal.

15. General Data Protection Regulation ("GDPR"):

Legal Rights under the GDPR

If you are located within the EU, you are entitled to certain rights under the GDPR. You have the right to:

  • Know how long we'll keep your information. Unless otherwise required by law, we'll keep your Personal Information until either (1) you ask us to delete your Personal Information, or (2) the Company decides it no longer needs the data and the cost of retaining it outweighs the value of keeping it. If we are unable to fully delete your Personal Information for technical or other operational reasons, we will take reasonable measures to ensure your Personal Information is not further processed. 

  • Access, rectify or erase your Personal Information.

  • Object to processing of your Personal Information. This right exists where we are relying on a legitimate interest as the legal basis for our processing and there is something about your particular situation that makes you want to object to our professing of your Personal Information on this ground. You also have the right to object when we are processing your Personal Information for direct marketing purposes.

  • Request the transfer of your Personal Information. We will provide to you, or to a third party you have chosen, your Personal Information in a structured, commonly used, machine-readable format. This right applies only to automated information that you initially provided consent for us to use or where we used the information to perform a contract with you.

  • Withdraw your consent to the Company's processing of your data, which shall have no effect on the lawfulness of the processing of your Personal Information before your withdrawal.

  • Lodge a complaint with a supervisory authority that has jurisdiction over GDPR issues.

  • Provide only your Personal Information that is reasonably required to enter into a contract with us. 

You may exercise your rights of access, rectification, cancellation and opposition by contacting us. We may ask you to verify your identity before responding to such requests.

Legal Basis for Processing Personal Information under the GDPR

We may process Personal Information under the following conditions:

  • Consent: You have given your consent for processing Personal Information for one or more specific purposes.

  • Performance of a contract: Provision of Personal Information is necessary for the performance of an agreement with you or for any pre-contractual obligations thereof.

  • Legal obligations: Processing Personal Information is necessary for compliance with a legal obligation to which the Company is subject.

  • Vital interests: Processing Personal Information is necessary to protect your or another person’s vital interests.

  • Public interests: Processing Personal Information is related to a task that is carried out in the public interest or in the exercise of official authority vested in the Company.

  • Legitimate interests: Processing Personal Information is necessary for the Company’s legitimate interests.

In any particular case, we will gladly clarify the specific legal basis that applies to the processing of Personal Information and, in particular, whether the processing of Personal Information is a statutory or contractual requirement or a requirement necessary to enter into a contract.

We are the Data Controller, as that term is used in the GDPR, of your Personal Information collected through www.rozziefitness.com. We and Meta are Joint Controllers, as that term is used in the GDPR, of our Facebook page.
